Road, Mahim (West), Mumbai 400 016, operating under its trade name \u2018<strong>Welling Homeopathy Clinics<\/strong>\u2019 (hereinafter referred to as \u2018<strong>Welling Healthcare<\/strong><strong>\u2019<\/strong>) is the owner of the domain name wellinghomeopathy.com (hereinafter referred to as the <strong>\u2018Website<\/strong>\u2019).<\/p>\n<p>The User hereby agrees that the use of the Website and Welling Healthcare\u2019s Services (defined below) are subject to the Terms and Conditions contained in this document as well as the Privacy Policy, Refund Policy any other rules and policies that Welling Healthcare may publish from time to time. This document and such other rules and policies contained on the Website are collectively referred to below as the \u2018<strong>Terms<\/strong>\u2019. \u00a0By accessing the Website or using the Services, User hereby agrees to accept and be bound by the Terms. The User hereby agrees that the User shall not use the Services if the User does not accept all of the Terms.\u00a0The User hereby acknowledges and agrees that Welling Healthcare may, without prior notice and at any time, amend, modify, replace, add or delete any portion of the Terms at any time by posting the relevant amended and restated Terms on the Website. Further Welling Healthcare also provides such homeopathy consultation and treatment by means of an online platform through the Website (hereinafter referred to as \u2018<strong>Services<\/strong>\u2019). A detailed description of the homeopathy consultation and treatment offered by Welling Healthcare is available under various sections on the Website.<\/p>\n<ul>\n<li>In pursuance and in furtherance of the Services, the Website offers features, including but not limited to the following:<\/li>\n<\/ul>\n<ul>\n<li>An option to book an online appointment for visiting any Welling Homeopathy Clinic under the \u2018Book Appointment\u2019 head;<\/li>\n<li>Providing information about various diseases and the treatment offered pertaining thereto under the head, \u2018Disease Info\u2019;<\/li>\n<li>\u2018Health Hub\u2019, a section comprising blogs and articles published by Welling Healthcare;<\/li>\n<li>An option to consult a specialist at Welling Healthcare, prior to availing Services; and<\/li>\n<li>An option to avail Services online.<\/li>\n<\/ul>\n<ol start=\"3\">\n<li><strong><u>ELIGIBILITY<\/u><\/strong><\/li>\n<\/ol>\n<ul>\n<li>To be eligible to access the Website, the User shall be competent to enter into legally binding contracts as defined under the Indian Contracts Act, 1872.<\/li>\n<\/ul>\n<ul>\n<li>However in case of a minor, the parent\/guardian of such minor may access the Website or manage the minor\u2019s account on behalf of the minor, subject to such parent or guardian fulfilling the condition mentioned in clause 3.1 above.<\/li>\n<\/ul>\n<ul>\n<li>Welling Healthcare reserves the right to refuse to grant the User access to the Website and the right to terminatethe User\u2019s registration if it is\u00a0brought to Welling Healthcare\u2019s notice or if it is discovered that the User suffers from any disability described above.<\/li>\n<\/ul>\n<ol start=\"4\">\n<li><strong><u>REGISTRATION<\/u><\/strong><\/li>\n<\/ol>\n<ul>\n<li>A User, in order to avail the Services, will be required to be registered as a Patient on the Website. The User shall fill in and submit the Registration Form, available on the Website for purposes of signing up for the Services. Upon such registration, Welling Healthcare may provide a Patient with a username and password to access and log into their account<\/li>\n<\/ul>\n<ul>\n<li>In consideration of the Patient\u2019s use of the Website, the Patient agrees to:<\/li>\n<\/ul>\n<ul>\n<li>Provide true, accurate, current and complete Patient Data about themselves as may be required by the Registration Form;<\/li>\n<li>Maintain and promptly update the Patient Data, and any other information, the Patient provides to Welling Healthcare, to keep it accurate, current and complete;<\/li>\n<li>Maintain confidentiality of the password and identification;<\/li>\n<li>Notify Welling Healthcare immediately of any unauthorized use of the Patient\u2019s account or other breach of security; and<\/li>\n<li>Accept all risks of unauthorized access to the Patient Data and any other information the Patient provides to Welling Healthcare<\/li>\n<\/ul>\n<ul>\n<li>The User will ensure compliance with all notices or instructions given by Welling Healthcare from time to time to enable the use of the Website.<\/li>\n<\/ul>\n<ol start=\"5\">\n<li><strong><u>PAYMENT<\/u><\/strong><\/li>\n<\/ol>\n<ul>\n<li>The Patient understands and agrees that the Services furnished by Welling Healthcare shall commence on payment of the fees by the Patient, in accordance with the kind of treatment availed, the period for which treatment is availed and other details as provided on the Website.<\/li>\n<\/ul>\n<ul>\n<li>The various payment options available on the Website are as follows:<\/li>\n<\/ul>\n<ul>\n<li>Credit Card\/Debit Card\/Net Banking;<\/li>\n<li>PayPal; and<\/li>\n<li>Offline payment through bank deposit.<\/li>\n<\/ul>\n<ul>\n<li>Welling Healthcare shall be entitled to terminate the Services furnished to the Patient in case of non-payment or delay or payment.<\/li>\n<li><strong>We don&#8217;t offer refund for any payment made for treatment on this website, including for any treatment duration not utilised due to patient&#8217;s decision. The User hereby further understands and agrees that any such termination may be effected without prior notice to the User.<\/li>\n<\/ul>\n<ul>\n<li>In the event of termination, the Patient acknowledges and agrees that Welling Healthcare may delete or deactivate the Patient\u2019s account immediately upon detecting any such reason, including without limitation, the contravention of the of the Terms, the Privacy Policy or of the Refund Policy. Further Welling Healthcare shall purge the Patient Data after returning the same to the Patient in a form requested by the Patient.<\/li>\n<\/ul>\n<ol start=\"11\">\n<li><strong><u>PATIENT DATA PROTECTION AND CONFIDENTIALITY<\/u><\/strong><\/li>\n<\/ol>\n<ul>\n<li>The ownership of the Patient Data shall lie exclusively with the Patient.<\/li>\n<\/ul>\n<ul>\n<li>The Patient Data shall be accessed only by persons duly authorized by the Patient and shall not be shared with any third party and shall not be viewed by any person other than Welling Healthcare, its doctors, its affiliates and associate companies, directors, officers and employees, if and when required. The User shall not have any objection with Welling Healthcare sharing such information.<\/li>\n<\/ul>\n<ul>\n<li>The Patient Data will be dealt with only for the purpose for which it is authorized and in a diligent manner.<\/li>\n<\/ul>\n<ul>\n<li>Any personal and identifiable information including the Patient Data that is required to be collected by Welling Healthcare shall be kept confidential in accordance with the provisions of Welling Healthcare\u2019s Privacy Policy. This includes without limitation, acts of God, war, riots, civil disturbances, cyclones, hurricanes, floods, earthquakes, storms and other natural calamities, epidemics, plagues, terrorist attacks, accidents, trade restrictions, acts of any government authority leading to a delay in adhering to the time lines of delivery, strikes, labour, employee difficulties, cyber hacking and other events or circumstances that are beyond the reasonable control of Welling Healthcare.<\/p>\n<ol start=\"14\">\n<li><strong><u>DISPUTE RESOLUTION AND GOVERNING LAW<\/u><\/strong><\/li>\n<\/ol>\n<ul>\n<li>All disputes or differences arising between the User and Welling Healthcare as to these Terms or any other matter in relation to or in connection with the User\u2019s use of the Website shall be referred to a sole arbitrator who shall be appointed by Welling Healthcare as per the provisions of the Arbitration and Conciliation Act, 1996 or any amendments thereto. The seat and venue of arbitration shall be Mumbai and the language shall be English.<\/li>\n<\/ul>\n<ul>\n<li>These Terms shall be governed by the laws of India and the courts in Mumbai shall have exclusive jurisdiction.<\/li>\n<\/ul>\n<ol start=\"15\">\n<li><strong><u>MISCELLANEOUS<\/u><\/strong><\/li>\n<\/ol>\n<p>If for any reason a court of competent jurisdiction finds any provision or portion of the Terms to be unenforceable, the remainder of the Terms will continue in full force and effect. These Terms (including the Privacy Policy and Refund Policy) constitute the entire agreement between Welling Healthcare and the User and supersede and replace all prior or contemporaneous understandings or agreements, written or oral, regarding the subject matter of these Terms. Welling Healthcare reserves the right to investigate complaints or reported violations of these Terms and to take any action, Welling Healthcare deems necessary and appropriate. Such action may include reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties. In addition, Welling Healthcare may take action to disclose any information necessary or appropriate to such persons or entities relating to User profiles, e-mail addresses, usage history, posted materials, IP addresses and traffic information. Welling Healthcare reserves the right to seek all remedies available at law and in equity for violations of these Terms<\/p>\n<ol start=\"16\">\n<li><strong><u>NOTICES<\/u><\/strong><\/li>\n<\/ol>\n<p>All of Welling Healthcare\u2019 notices, demands and other communications must be in writing and will be deemed to have been given (a) if sent by electronic mail or (b) if delivered by overnight courier, and such message is confirmed as received, in each case to the address or e-mail address specified by the User on the Website.
